Former drum instructor gets jail time for sexual abuse

The former Greencastle- Antrim High School marching band co-percussion instructor has been sentenced to four to 23 months in the Franklin County Jail for having an inappropriate contact with a student.

Malcolm McCoy, 39, 11005 Coventry Lane, Hagerstown, Md. pleaded guilty to sexual abuse of a child in a plea agreement Dec. 5 and was sentenced last week in Franklin County Court by Judge Douglas W. Herman.

Under the sentencing McCoy will also be required to register as a sexual offender for the next 10 years. He was also fined $250 and must undergo DNA testing. While jailed, McCoy is not allowed to have unsupervised contact with a female under the age of 18. He will also continue private counseling and group therapy sessions.

McCoy appeared in Franklin County Court of Common Pleas Dec. 6 and admitted to possessing nude photos of a minor female student he met in July 2006.

He had initially been charged with involuntary deviate sexual intercourse, aggravated indecent assault, sexual abuse of children and indecent assault for a series of incidents beginning in February 2007. According to court documents, the girl told Pennsylvania State Police on April 17 that she met McCoy through GAHS and they began exchanging emails of a sexual nature. He visited her home twice.

McCoy made similar state- ments to police April 24 in the presence of his lawyer James Reed.

The Pennsylvania State Police report said that McCoy asked the girl to send him naked pictures of herself, which she did.

McCoy was hired by the school district as a supplemental staff employee Sept. 7 but began work with the band during the summer. His contract had expired by the time of the allegations, but he was also terminated at that point. School officials had notified police after a tip from a set of concerned parents.

McCoy was free on $1,000 bond prior to sentencing. He could serve four months in county prison, 19 months on parole and seven years probation. He will also have to register as a sexual offender
