Brief to be filed on behalf of golf course

Attorneys for Greens of Greencastle expect to file a motion for summary judgment in Federal District Court within the next two weeks. Alaw firm in Harrisburg is now handling the case involving the efforts of local developer Dan Sheedy and Admar Homes to prevent Greencastle GIBC of Norwalk, Conn., from turning the golf course into residential housing.

James Stein, an attorney with Dick, Stein, Schemel, Wine and Frey LLC, said once the motion is submitted to the judge, the owner of the course will respond.

"If we win the summary judgment, the case is over. If we lose, we go to trial," said Stein.

He added it was at the court's discretion whether there would be oral arguments. Sometime judges rule on the documents alone.

Greencastle GIBC purchased the golf course on July 1, 2005 and on July 19, 2006 submitted plans to Antrim Township to convert the property into a 191-lot subdivision. It would follow Conservation By Design criteria established by the township in May 2006.

The plaintiffs and defendants disagree on the wording and interpretation of the deed, specifically whether it requires the land to remain a golf course when the title changes hands.
